National Council on Independent Living 2014 Advocate's Guide to the Hill Each year, the highlight of the NCIL Annual Conference is the convergence of members from across the country, who unite on Capitol Hill to share stories of discrimination, institutionalization and segregation with their Senators and Representatives. The message is loud and clear: Independent Living is a civil right we are willing to fight for! We will be lining up outside of the Grand Hyatt Hotel along 11th & G Streets NW at 9:30 a.m. for the March. Participants will be divided up into their respective regions where signs will be distributed by state. We will begin marching at 10:00 a.m. sharp. The March route is a little over one mile long. We have an area designated at the Capitol Reflecting Pool / Union Square, near 3rd Street and Pennsylvania Avenue (see page 6 for details). The Rally will begin at 11:30 a.m. Please feel free to join the Rally even if you are not able to participate in the March. Lunch will be provided to conference registrants. The March and Rally will occur rain or shine so it is important to dress appropriately for the weather and be prepared to spend most of your day outdoors on Capitol Hill. Be sure your chair is fully charged, and you have enough medications, supplies, snacks, and drinks to get you through the day. As we learned in years past, it is imperative that people who use power wheelchairs or electric scooters bring plastic bags to protect batteries and controls in case of rain. After the Rally, NCIL members are strongly encouraged to go and meet with their elected officials to discuss pressing legislation impacting people with disabilities and Independent Living nationwide. [Map of U.S. Capitol Complex] About your visit to Capitol Hill Security Notice: In order to meet with your elected official, you will have to pass through a security screening in all House and Senate office buildings. You are encouraged to bring photo ID with you on your Capitol Hill visit. All bags are subject to thorough search and security screening. If you have any of the following items with you on your visit to Capitol Hill, you may not be allowed to visit your representative. Prohibited items include: - Mace and pepper spray - Any sharp or pointed object - Knives of any size, including pocket knives - Cans and bottles - Any bag larger than 14" wide x 13" high x 4" deep (per security discretion) - Weapons of any kind - Non-aerosol spray - Aerosol containers - This is an abbreviated list. If in doubt, leave it at the hotel! Tunnels: Both the Senate and the House Office Buildings are connected by a series of underground tunnels. Once you pass through security to either the Senate or the House Office Buildings, you can move about freely between buildings of that office without having to repeatedly go through security. The interconnecting tunnels can be found in the basements of both the Senate and House Office Buildings. Hill Cafeterias: Have some down time in between appointments once you are in the House or Senate Office Buildings? Both offer a number of places to have everything from a quick snack, to a full meal. For more specific information on directions to tunnels, eateries, or to your representatives' office, feel free to ask Hill staff or security. House Office Buildings: - Longworth Basement: Cafeteria - Rayburn Basement: Coffee and Sandwich Shop Accessible Entrances - Capitol Visitor Center - Main entrance at First and East Capitol streets. - Capitol - Public Tours enter on the South or House Side of the Capitol, which is accessible. - Russell Senate Building - Delaware entrance on ground level closest to Constitution Ave. - Dirksen Senate Building - First Street and C Street entrance. - Hart Senate Building - Second Street entrance. - Cannon House Building - Entrance on New Jersey Avenue, SE, south of the terrace at the intersection with Independence Avenue. - Longworth House Building - Main entrance, Independence and New Jersey Avenues. - Rayburn House Building - Main entrance, horseshoe drive off South Capitol Street. - Ford House Office Building - Entrance on 3rd Street, SW, near intersection with D Street, SW [Maps of House and Senate Buildings] Understanding Congress: Tools to Advance Policy Priorities The Legislative Process: How Bills Become Laws… or Not Each session, the United States Congress considers thousands of bills. Yet only a small percentage of them will ever reach the top of the President's desk for final approval or veto. Along their way to the White House, bills traverse a maze of killer committees and subcommittees, debates, and amendments in both chambers of Congress. The following is a simplified explanation of the typical process required for a bill to become a law. Congressional gurus will find some details missing, but here are the basics. Step 1: Introduction Anybody -- you, me, the President, can write a bill; but only a member of Congress (House or Senate) can introduce the bill for consideration. The Representative or Senator who introduces the bill becomes its "Sponsor." Other legislators who support the bill or work on its preparation can ask to be listed as "Co-sponsors." Important bills usually have several Co-sponsors. Four basic types of legislation are considered by Congress: Bills, Simple Resolutions, Joint Resolutions, and Concurrent Resolutions. A bill or resolution has officially been introduced when it has been assigned a number (H.R. # for House Bills or S. # for Senate Bills), and printed in the Congressional Record. Step 2: Committee Consideration All bills and resolutions are "referred" to one or more House or Senate committees according to their specific rules. Step 3: Committee Action The committee considers the bill in detail. For example, the powerful House Ways and Means Committee and Senate Appropriations Committee consider a bill's potential impact on the Federal Budget. They ask "Can we afford this thing?" If the committee approves the bill, it moves on in the legislative process. Committees reject bills simply by not acting on them. Bills that fail to get committee action are said to have "died in committee." Many do. Step 4: Subcommittee Review The committee sends some bills to a subcommittee for further study and public hearings. Congress can ask just about anyone to present testimony at these hearings. Government officials, industry experts, the public, anyone with an interest in the bill can give testimony if they are invited. Step 5: Mark Up If the subcommittee decides to report (recommend) a bill back to the full committee for approval, they may first make changes and amendments to it. This process is called "Mark Up." If the subcommittee votes not to report a bill to the full committee, the bill dies right there. Step 6: Committee Action - Reporting a Bill The full committee now reviews the deliberations and recommendations of the subcommittee. The committee may now conduct further review, hold more public hearings, or simply vote on the report from the subcommittee. If the bill is to go forward, the full committee prepares and votes on its final recommendations to the House or Senate. Once a bill has successfully passed this stage it is said to have been "ordered reported" or simply "reported." Step 7: Publication of Committee Report Once a bill has been reported, a report about the bill is written and published. The report will include the purpose of the bill, its impact on existing laws, budgetary considerations, and any new taxes or tax increases that will be required by the bill. The report also typically contains transcripts from public hearings on the bill, as well as the opinions of the committee for and against the proposed bill. Step 8: Floor Action - Legislative Calendar The bill will now be placed on the legislative calendar of the House or Senate and scheduled (in chronological order) for "floor action" or debate before the full membership. The Speaker of the House and House Majority Leader decide the order in which reported bills will be debated. Step 9: Debate Debate for and against the bill proceeds according to the rules of the House or Senate. Step 10: Voting Once debate has ended and any amendments to the bill have been approved, the full membership will vote for or against the bill. The vote may be a voice vote or a roll-call vote. Step 11: Bill Referred to Other Chamber Bills approved by one "chamber" of Congress (House or Senate) are now sent to the other chamber where they will follow pretty much the same track of committee to debate to vote. The other chamber may approve, reject, ignore, or amend the bill. Step 12: Conference Committee If the second chamber to consider a bill changes it significantly, a "conference committee" made up of members of both chambers will be formed. The conference committee works to reconcile differences between the Senate and House versions of the bill. If the committee cannot agree, the bill simply dies. If the committee does agree on a compromise version of the bill, they prepare a report detailing the changes they have proposed. Both the House and Senate must approve the report of the conference committee or the bill will be sent back to them for further work. Step 13: Final Action - Enrollment Once both the House and Senate have approved the bill in identical form, it becomes "Enrolled" and sent to the President of the United States. The President may sign the bill into law. The President can also take no action on the bill for ten days while Congress is in session and the bill will automatically become law. If the President is opposed to the bill, he can "veto" it. If he takes no action on the bill for ten days after Congress has adjourned their second session, the bill dies. This action is called a "pocket veto." Step 14: Overriding the Veto Congress can attempt to "override" the President's veto of a bill and force it into law, but this requires a 2/3 vote by a quorum of members in both the House and Senate. Glossary of Legislative Terms Act: The term for legislation that has been passed by Congress and signed into law by the President. Amendment: The proposal of a member of Congress to alter the wording of a bill being considered by a subcommittee, committee, or on the House or Senate floor. Amendments can also be offered to add or delete entire sections of a bill. Appropriation: Legislation that directs the spending of funds from the federal treasury for a specific purpose, e.g. funding for the Department of Health and Human Services. By custom, an appropriations bill originates in the House, where it is assigned an H.R. number (e.g. H.R. 5027) until it becomes law or is vetoed by the President. Typically, each appropriations bill includes funding for several hundred federal programs. Authorization: A law creating a new federal program or extending the life of an existing program. An authorization establishes the framework for operating a federal program, and usually sets the maximum amount of funds that can be given to a program for a period of 3 to 5 years. Bill: A proposed law introduced by a member(s) of Congress. Budget: The document the President sends to Congress each year outlining federal expenditures and revenues for the upcoming fiscal year. The President's budget is usually submitted to Congress in late January or early February. Budget Resolution: Legislation passed by Congress each year, which sets overall limits on spending and revenues. Congressional committees use the budget resolution as a guide for allocating funds to specific federal programs. The budget resolution does not require the President's approval. Conference: A meeting between House and Senate members to reconcile differences between bills passed by their respective chambers of Congress. Once a compromise has been ironed out, a conference report is issued and voted on by the full House and Senate. The measure is then sent to the President for approval. Continuing Resolution: An emergency appropriations bill that provides funding for federal agencies whose regular appropriations bills have not been passed before the end of the federal government's fiscal year (September 30). Entitlement: A federal program that guarantees a certain level of benefits to persons who meet requirements set by law, such as Social Security and unemployment benefits. Congress and the President generally have very little discretion over spending by these programs. Fiscal Year: For the federal government, the fiscal year runs from October 1 through September 30. Hearings: Committee meetings where testimony is taken from witnesses representing government agencies, private sector organizations and the general public. Most congressional hearings are accessible to the public. Hearings may be held in Washington, DC, or in local communities. Mark-Up: A subcommittee or committee meeting for the purpose of writing legislation. Once completed, the measure is ready for debate on the floor of the House or Senate. Public Law: A bill after it has been passed by the House and Senate and subsequently approved by the President. Reconciliation bill: Legislation that contains changes (usually spending cuts) to existing laws so as to conform - or reconcile - with policies adopted in the budget resolution. Rescission: The act of canceling appropriations already enacted into law. Standing Committee: A committee that is permanently established by House and Senate rules. Standing committees are empowered to prepare and review legislation (as opposed to select committees, which serve only to advise Congress on a limited range of issues). Veto: The President's formal disapproval of legislation passed by Congress. When Congress is in session, the President must veto a bill within 10 days after receiving it from Congress; otherwise it becomes law. A bill can become law after a veto if two-thirds of Congress votes to override the veto. Major Differences between the Two Houses of Congress Terms - House: 435 members serving two-year terms - Senate: 100 members serving rotating six-year terms Referral of Bills - House: Speaker's referral of bills to committee is hard to challenge - Senate: Referral decisions easy to challenge Committee Consideration - House: Committees almost always consider legislation first - Senate: Committee consideration easily bypassed Rules Committee - House: Rules Committee powerful; controls time of debate, admissibility of amendments - Senate: Rules Committee weak; few limits on debate or amendments. Debate - House: Debate usually limited to one hour - Senate: Unlimited debate unless shortened by unanimous consent or cloture Amendments - House: Non-germane amendments may not be introduced from floor - Senate: Non-germane amendments may be introduced (riders) Leadership Structures House of Representatives Leadership Structure 1. Speaker of the House: John Boehner (R-OH). Acts as leader of the House in several roles: the institutional role of presiding officer and administrative head of the House, the role of leader of the majority party in the House, and the representative role of an elected member of the House. 2. Majority Leader: Eric Cantor (R-VA). Represents Republicans on the House floor. 3. Majority Whip: Kevin McCarthy (R-CA). Assists leadership in managing party's legislative program. 4. Republican Conference Chairman: Cathy McMorris Rodgers (R-WA). Heads organization of all Republican Party members in the House. 5. Republican Policy Committee Chairman: James Lankford (R-OK). Heads Conference forum for policy development. 6. Democratic Leader: Nancy Pelosi (D-CA). Represents Democrats on the House floor. 7. Democratic Whip: Steny Hoyer (D-MD). Assists leadership in managing party's legislative program. 8. Assistant Democratic Leader: James Clyburn (D-SC). Works with caucuses and as liaison to Appropriations Committee. 9. Democratic Caucus Chairman: Xavier Becerra (D-CA). Heads organization of all Democratic Party members in the House.
